    When HSE inspectors came to review the case, it was decided that a breach of health and safety had been brought about by asking the injury victim and his colleague to work on piping that was deemed to be far too heavy or just 2 workers to handle.

    The problem with the incident related above is that a proper risk assessment had not been carried out prior to the commencement of the operation. Had a risk assessment been done in advance, it should have been recorded that the pipe in question was to heavy to be handled by only two workers.

    This highlights the importance of carrying out effective risk assessments. All too often employers make assumptions that turn out to be incorrect, and when they do so, and workers get injured as a result, they will be liable to be sued for injury compensation
