    The idea of no win no fee came about at the end of the nineties when the government first began cutting back on legal aid and then abolished it altogether. For a long while lawyers were allowed to claim all their expenses, including success fees, from the other side. However, the insurance industry, which had to pay most of these claims, lobbied hard against this claiming and this would lead to increased insurance premiums for everyone. The government agreed and stopped law firms from claiming from the other side with a law which came into force in 2013.

    This means that if you make a claim you will have to pay success fees. This will normally come out of your compensation claim. However, the government has pushed up the amount that can be claimed, so while you’re paying more, you should in theory receive more in compensation.

    Getting the right lawyer

    However, that all somewhat depends on whether you have the right lawyer on your side or not. There is a huge difference in the quality of service different law firms can provide on any single case. Personal injury law is a complicated beast and most firms will only be able to help on those cases, which they have the in house expertise. For example, you may find one firm which specialises in road traffic accidents and another which focuses on claims for medical negligence. You’ll need to find someone who understands the type of case you’re fighting.
