    The biggest change to personal injury law in recent time came at the end of the century when the government removed legal aid from the vast majority of personal injury cases. This meant that if you wanted to make a claim you were – from the official standpoint – pretty much on your own. That brought all sorts of problems. The majority of people could not afford to pay their own legal fees if they lost their case which meant, unless you were prepared to take a pretty big risk with your finances you might find that the legal system was pretty much off limits unless you managed to up your income considerably.

    The solution came in the form of no win, no fee’. A firm was allowed to take on all the risks of making a claim in return for being able to charge a little bit more. This meant that as a client you were in some respects subsidising those who had not been successful making a claim and also that you were paying a little premium for the peace of mind that comes from having the back up of ‘no win, no fee’.

    For a while, lawyers were allowed to claim their success fees from the other side which meant you could end up paying nothing no matter what happened. However, the insurance firms lobbied hard against this and the situation was returned to you having to pay your fees if you won. This means that you will always be slightly under compensated as a result which is why it’s important to choose your law firm carefully and to make certain that you receive the full amount of compensation to which you should be entitled.
