    "If you've been injured through no fault of your own you could be entitled to compensation. If you're unsure if you could claim, I recommend you call Accident Advice Helpline."

    Road traffic accident injury claim

    A road traffic accident injury claim is probably the second most common of personal injury claims, after claims for slips, trips and falls. Over 3 million accidents happen every year in the UK, the majority of which fall into one of these two categories, work-related accidents being the next most common.

    Accidents are not usually intentional, but are normally caused through the negligence or recklessness of someone. The problem is that quite often, there is an innocent party that sustains injuries through no fault of their own.

    What an innocent party can do

    If you find yourself the innocent party to an accident, you may be entitled to claim compensation from the person who caused the event. UK law has stipulations regarding this — you need to fit the criteria to be able to proceed, whether it is a road traffic accident injury claim or a claim for any other type of accident. The rules say:

    • The accident must have been the fault of someone else;
    • You must have sustained injuries in the accident;
    • Your injuries must have needed medical attention; and
    • The accident must have happened within the last three years.

    A road traffic accident injury claim is the same as any other compensation claim

    A road traffic accident injury claim is no different to other personal injury claim, providing you fit the criteria. In all cases you could be awarded compensation for the injuries you have sustained and the impact they have had on your life. For some this will be very little, but in other cases it may be that they will never be able to work again, or they could need 24-hour care.

    As well as the pain and suffering, you can claim for any expenses you incur because of the accident, and that can be much more than you would think. It is surprising how prescription charges, taxi fares, care costs and everything else add up to a large amount of money at a time when your income could be reduced if you normally work and have a reduced income from your job.
