No win no fee compensation in East Hertfordshire

Personal Injury Solicitors in East Hertfordshire

When you can’t make a no win no fee* compensation in East Hertfordshire claim against an employer

Simply having an accident in the work place does not automatically entitle you to make a no win no fee* compensation East Hertfordshire claim against your employer. The fact is that in order to make a successful claim for compensation against someone else you need to be able to prove that this someone is liable or responsible for your accident. If you and your solicitor can do that, then a claim can be made. However, if you are responsible for the accident and resulting injuries then it will not be possible to secure compensation.

    Personal Protection Gear

If you are injured as a result of not wearing personal protection gear then this might be the fault of your employer, in which case you could make a no win no fee* compensation East Hertfordshire claim against them. For example, if your employer does not provide you with suitable protection, or fails to identify situations in which it might be of use to you, then this could be deemed to be their fault if you are injured as a result.

However, if your employer does identify a situation and, due to the nature of your contract, advises you that it is your responsibility to provide your own protective gear and make sure you wear it appropriately, then they will not be deemed responsible if you are injured as a result of any failings on your part.

    Training

Your employer is responsible for ensuring that you are suitably trained for the tasks that you need to do. This can include making sure that you know how to operate certain machinery, and what to do if that machine breaks down. If your employer advises you that in the case of a machine malfunction you are to contact a supervisor, or the maintenance team rather than dealing with the issue yourself, then you cannot hold them accountable if you do not heed  this instruction.
