    Initially, the riding school refused to accept liability, saying that all riders signed a waiver that clearly outlined they were taking the risk. However, on investigation it appeared that the horse in question had not been at the riding school longer than 2 weeks, hence they were in no position to say from their experience that the horse was fit for such a novice rider.

    In a nutshell, as with all compensation claims, there are three factors that need to be fulfilled in order to make a claim:

    • The accident must not have been your fault and, as in this case, your lawyer will need to ensure that they build a case that clearly shows that liability, that is, the fault for the accident lays with the ‘other side’
