    Winter slips accident claim

    During the colder months of the year we often pick up the phone to find it’s somebody who wants to make a winter slips accident claim. The good news about claims of this type is that they’re fairly straightforward to bring.     Rules for claiming

    Sadly, not every winter slips accident claim people call us about can be taken forward. This is because there are regulations that affect what counts as a legitimate claim. Understanding these can help you to avoid disappointment.

    First and foremost, claims have to be made within three years of the accident happening. The only exception is for people who are children at the time. An appropriate adult can claim on a child’s behalf within the three-year period, or the child can claim within a three-year period that begins at the age of 18.

    Alongside this, claims can only be processed if a doctor treated the injured person soon after the accident. Occasionally, a later visit can be adequate if an injury that didn’t become apparent until later can be clearly traced to the accident, but the bottom line is that there must be a medical record of the injuries that doesn’t allow for doubt over how they were caused.

    Finally, the accident must not be your own fault. This can be trickier to work out than it sounds, so if you’re uncertain, give us a call. In some cases you may still be able to claim if we think you are partially liable (where the main fault lies with someone else), but you should never discuss this with anyone other than your solicitor.
