Can I claim compensation for having to take time off work?

The point of accident compensation is not just to make you feel better but also to help you to recover the way of life you had before the accident. It is therefore important that you can claim compensation for having to take time off work.  In the majority of cases this is possible, and at Accident Advice Helpline we are happy to assist.  You can call us at whatever time is convenient, on any day of the week, and we will discuss your situation with you so you can understand your options.

    Proof of losses

In order to claim compensation for having to take time off work, you will need to be able to demonstrate loss of earnings.  If you are an employee you can usually put your solicitor in touch with your boss and have them work this out.  If your earnings are irregular because, for instance, you are on a zero-hours contract, a figure for estimated losses will be arrived at based on an average of your earnings.  The same applies if you are self-employed or a freelance contractor, but in this case you will need documents such as bank statements or tax return slips as proof of earnings.

    A valid claim

The vast majority of compensation claims need to be made within three years of the accident happening.  The sooner you make a claim, the more likely it is to be successful; therefore, it is best to get started as soon as you feel up to it.  For your claim to be legitimate you will need to have received formal medical treatment for your injuries so that there is a record linking them to the accident.  If you can take photos of your injuries, this can help to build up the evidence in support of your claim.

    Making a claim

If you want to make a claim, Accident Advice Helpline can help.  We can put you in touch with a solicitor who specialises in the kind of accident you suffered so that you have got the best possible representation.  As we use a no-win, no-fee system, you will not need to have money to begin the claims process and we will not charge you at all if we lose.  We are confident that we can win a large majority of the claims we take on; with this extra motivation, you can be confident that we are 100% on your side.

In most cases, claiming does not take long.  Where there are likely to be delays, your solicitor will warn you in advance.  We do all we can to keep the claims process simple for you because we know that you do not need anything else sapping your time and energy.  You will be able to deal with your solicitor over the phone and we will keep any travel required to a minimum.
