    Injury claim jargon buster: Certiorari

    Certiorari is the name for a legal remedy which is used in conjunction with judicial review. It’s important to provide a little background on judicial review in order to fully understand the term.

    Judicial review is different from an appeal. Whereas an appeal is seen as a complete rerun of proceedings to decide on a point of fact, a judicial review is only concerned with a point of law.

    This means that judicial review is not strictly concerned with what decision was made in the case, but rather how the decision was met.

    Certiorari brings the argument before a court that a decision was unlawful and should be quashed. This may happen in cases where a judge has misinterpreted and falsely applied a law to a certain set of circumstances.
