Can I claim if I have a non-exercise related gym accident?

Accidents at the gym are a common occurrence, especially so due to the variation of techniques adopted and range of machines available for use.  While severe gym-related injury can be sustained through over exertion or incorrect use of equipment, sometimes accidents occur in the gym that are not exercise related.

From slips, trips and falls in shower areas to head/facial injuries from automatic lockers, if you sustain an injury while using the gym, is it possible to claim compensation for the harm you have suffered?

Personal injury compensation: A non-exercise related gym accident

When visiting your gym of choice, the owner has a legal obligation to ensure your health and safety while you are using the facilities and throughout the premises.

That considered, if you sustain an injury due to poor maintenance, layout or gym amenities, for example, the business may have failed in their duty of care, and therefore, could be held liable for any type of accident in the gym.

Whether your accident at the gym resulted in injury due to an insufficient induction programme or you experienced a fall due to an unmarked wet floor, the reason for causation of your accident is merely the basis of your claim and cannot automatically rule out your eligibility.

    Checking eligibility to claim

First and foremost, before you consider claiming personal injury compensation for your slip, trip, fall or other accident at the gym, you must be sure that the incident in question occurred within the last three years.

In addition, you need to be able to provide evidence to suggest liability lies with the business owner. It is wise to take photographs of the issue that caused your accident at the gym and collect the details of anyone who witnessed the incident.

In most cases, a genuine claim will be backed up with medical records. Be sure to visit your GP, medical centre or accident and emergency service, depending on the severity of your gym-related injury, to receive advice and treatment for your illness or injury.
