If a handyman injures themselves on your property, are you liable?

Slips, trips and falls around the home are relatively standard domestic accidents. With this in mind, if you employ a contractor to carry out work on your home, and a handyman injures themselves while working on your property, can you be held liable?

Are you liable if a handyman injures themselves?

When you employ a contractor to come into your home and carry out work, you can be held liable if a handyman injures themselves under some circumstances.

Of course, you can’’t be held responsible in all cases when a handyman injures themselves, but if your handyman injures themselves due to an issue with your home or poor maintenance, you can be held liable.

This means to say, if you or your home has caused the contractor accident in question, as opposed to their tools, equipment or poor work practices, liability is likely to be in your hands.

The claims process for handyman injuries

Whether your handyman suffered a trip due to unmaintained grounds or a more severe accident caused by gas or electrical faults, when a handyman injures themselves you must do all you can to ease the harm and distress they are experiencing.

In all cases, ensure that medical attention is given for all handyman injuries. You will also need to keep records of the issue that has caused the accident in your home. Photographs are helpful to keep factual reports fresh in the mind.

After your handyman injures themselves, you will need to wait to hear if they have chosen to claim personal injury compensation. You will receive a Letter of Claim in the post from their solicitor regarding the accident in your home, to which you are usually given 21 days to respond.

It is always advisable to seek professional legal advice.
