Have you been injured as a passenger?

In 2016, more than 181,000 people were reported injured on Britain’s roads. Of these, about 60 per cent were car occupants¹.

In a road accident, passengers often come off the worst. If you’ve been injured as a passenger, we may be able to help you claim compensation.

When you have an accident, you need the right help, tailored to your situation. If the accident wasn’t your fault, you shouldn’t have to pay for the consequences, or chase around trying to find the right specialist.

We make it simple to get the right advice and help, with just one free phone call. Our support will help you to recover more quickly.

Who was at fault?

Road accidents have many different causes.

If your accident arose from poor road conditions, such as a pothole or crack, you may be able to claim compensation from the party responsible for maintenance, such as your local council or the Highways Agency. Making a claim for compensation will flag up the fact that the road has not been maintained properly, which may help to avert accidents in future.

You may have been injured while travelling on public transport – through a collision, a fall or a bump caused by careless driving, for example. Drivers of buses, coaches and taxis are under obligation to drive safely and responsibly. If your driver failed in this duty of care, you could claim compensation.

Perhaps you were injured in an accident caused by a friend or family member who was driving the vehicle you were in. You might feel uncomfortable about claiming for compensation in this situation, but insurance companies cover these claims. The driver won’t be liable to pay the bill, and won’t be left out of pocket.

If the driver was over the limit for drugs or alcohol and you were aware of this, this might affect the level of compensation you could receive. If you weren’t aware, your compensation will not be affected.

All drivers are obliged by law to have insurance, but some do not. In this case, you can still make a claim. If it succeeds, your compensation will be paid by the Motor Insurers’ Bureau.

If you were a motorcycle passenger, we can also help you. Motorcycle accidents can cause serious injuries.

Why claim when you’ve been injured as a passenger?

Treating an injury may be a lengthy process. It can cost time and money to put things right. Sadly, some injuries cause permanent disabilities, while others need treatment in specialist rehabilitation units.

If you need to take long periods off work, for treatment or to recover, you may find it difficult to keep up with the mortgage, rent or household bills. You might also have to depend on someone else to help you. Claiming compensation for loss of earnings could enable you and your family to cope.

Road traffic accidents can leave passengers with serious injuries. If you suffer a life-changing injury that leaves you unable to return to normal, compensation could make all the difference.

Making a claim might seem like extra hassle, but compensation can help to ease the stress, covering medical costs, loss of earnings and continuing care. It also compensates you for the pain and suffering. If you suffer a serious injury, it can help you adapt your home, car and way of life.

We are here to support you. When you call us for free on 0800 689 5659, one of our friendly, legally trained advisors will help you talk through your situation.

Can you claim for your injury?

We’ve helped many passengers claim compensation after road accidents. Each case is different, but we will work on your behalf to make sure you get the right amount of compensation.

Our online claim calculator can help you to understand how much compensation you could receive if your claim is successful.

It’s important to note that by law, every passenger over the age of 14 must wear an adult seatbelt if available, and children must wear a child restraint or seatbelt. If you’ve suffered injury as a passenger in a road accident but weren’t wearing a seatbelt, you may receive less compensation for your claim.

To make a claim, generally you’ll need to be able to answer ‘yes’ to the following questions:

  • Did the accident happen within the last three years?
  • Did someone else cause the accident?
  • Did you suffer injury?

As we help you to build your case, we’ll consider:

  • Your pain and suffering
  • Any loss of earnings due to time off work
  • Impact on your ability to work and earn in future
  • The effects your injury has had on your social life and hobbies
  • Costs of medical treatment, medication and home adaptation
  • Any care you’ve received, even if it’s been given for free
