It’s only a few steps to your compensation claim
This article will explain the steps necessary to claim for compensation.
Right after you have been injured
If you were involved in an accident, collect the following:
- Take photographs of the scene and any damage or ask a witness to take some.
- Ask your witnesses to send you the photographs as soon as possible.
- Make sure to exchange contact details with all parties involved
- If a motorised vehicle or multiple vehicles were involved, make a note of the number plates.
- If you have any visible injuries, take photographs of those as well.
- Don't sign a record of your accident. You have the right to withhold your signature and seek legal advice first.
Seek medical assistance
If you have been injured, you should seek medical assistance as soon as possible. Not only is it important that you get yourself checked to make sure you are ok, it is also important that you have as much detail about your injury as possible. It will simplify the claims process.
Seek legal representation
It is advisable that you seek legal presentation for your compensation claim. Make sure to choose a legal partner that doesn't charge you with unexpected fees or costs.
Your legal representative will most likely ask you to see another medical professional to get a third, unbiased opinion. This is not to humiliate you but to strengthen your compensation claim. It helps to estimate the full amount of costs and losses that should be covered in your claim.
Depending on how complex your claim is, we will help you to gather further evidence. We will collect witness statements and any CCTV footage to assist your case.
If you have suffered serious injuries and the negligence of the other party is fairly obvious, we can claim for an early partial-payment to take off some of the psychological and financial burden to you so you can receive any rehabilitation, specialist treatment/aids or home adaptations quickly.
Outside of court settlement
For both parties, it is worthwhile to settle the case outside of court. It shortens the process and most victims want to get on with their daily life or adapt to their new situation as soon as possible. This is why in many cases, an agreement between yourself, your representative and the insurance company can be reached outside of court.
If negligence is disputed by the defendant or an agreement can't be reached outside court, we will take your compensation claim to court. We will guide you through any hearings and will present your case in front of the judge to make sure you receive the compensation you deserve.
