    Deciding whether or not to make York claims against your employer after an accident you have suffered which was not your fault can be difficult. Although you have up to three years to process your claim after the accident, making a claim is much easier if you make a start on it as soon after the accident as possible, whilst all of the evidence is still fresh. This means that you really do need to decide if you are going to go ahead with the claim sooner rather than later. Here are some ways to decide if it is a good idea for you to claim against your employer.

    Was the accident your employer’s fault?

    If there is any doubt that the accident was your employer’s fault then you are best off speaking to an injury lawyer before you proceed to ensure that you have a good enough case for compensation. However, if you know for sure and have evidence to prove that the accident was the fault of your employer, then you should definitely go ahead with a claim.

    Are you going to have to be off work for a while?

    Taking a long time off work can be psychologically and financially damaging, so if your injuries are forcing you to sit out from work for quite a long time then a compensation claim may be the best way for you to get back on your feet and feel as though you have gotten what you deserve from your accident.

    Will you be able to keep your job?

    Your employer is not legally allowed to fire you from your job if you make a claim against them, and you should be aware of this. Do be aware that claiming compensation may not make you your employer’s favourite employee as well, though.
