How are whiplash claim amounts calculated?
The amount you can receive in a claim depends on numerous factors. For example, are you nursing a mild case of whiplash? Have you had to take any time off work to heal, and has this impacted your household income? Have you had to pay for any medical treatments such as physiotherapy, or pain medicine such as codeine or paracetamol? These and other factors are taken into consideration when weighing up how much you could be entitled to receive back from the negligent party responsible for your accident.
How do I know if I can make a claim?
The law states that if you’ve been injured in an accident that was caused by someone else, you have a right to make a compensation claim. If another driver caused the collision in which you sustained whiplash, and you can prove unequivocally that you weren’t at fault, you’re protected under UK law and have a right to receive the full amount in damages.
Can I receive remuneration for an accident that happened years ago?
Yes – you have up to three years after an accident to make a claim for whiplash.
