"If you've been injured through no fault of your own you could be entitled to compensation. If you're unsure if you could claim, I recommend you call Accident Advice Helpline."

    West Lancashire accident

Your employer has a basic legal duty to take reasonable care for your safety while you are at work. Therefore, if you have an accident and sustain an injury during the course of your working day, you will be able to hold your employer accountable.

To receive compensation for your employer’s carelessness, you must be able to prove that your employer failed to fulfil one or more of the following four legal obligations:

    1. Safe equipment and machinery
If you sustain an injury while using unsafe equipment and machinery, and you can prove that your employer failed to implement a system of regular maintenance and inspection, you will be able to make a West Lancashire accident claim.
    2. Safe and competent work colleagues
Your employer is directly responsible for the actions of your coworkers. Therefore, if you suffer an injury as a result of your coworker’s carelessness, you will be able to sue your employer.
    3. Safe systems of work
Your employer must implement safe systems of work and ensure that these systems are maintained and modified as necessary. If you sustain an injury as a result of your employer’s failure to ensure that safe systems of work were in use, your employer will have to pay you compensation.
    4. Safe working environment
Your employer must provide you with a safe working environment. As you will have come to expect, this duty generally overlaps with those listed above. If you suffer an injury as a result of working in an unsafe environment, you will be entitled to claim compensation.

Make a West Lancashire accident claim against your employer

You may feel reluctant to sue your employer, especially if you assume that a claim could cost you your job. The law requires your employer to have an insurance policy in place to pay out for compensation claims. Therefore, your compensation settlement will derive not from your employer’s profits but from your employer’s insurance company.

At Accident Advice Helpline, we will ensure that your West Lancashire accident claim progresses as smoothly as possible and does not affect your relationship with your boss. We will also fight for the maximum compensation settlement on your behalf.

If you think you have a claim please call our Freephone number on 0800 689 0500 or 0333 500 0993 from a mobile phone, and let our experienced legal team assess your case. Alternatively, use our free, no-obligation 30-second test.
