Because legal fees would come out of their compensation claim this would mean they were in effect being sold short. Therefore they decided that lawyers could claim all their fees including their success fees from the other side. This left customers able to collect all the compensation.

4. A final change

This was bad news for insurance companies as it increased the amount they would have to pay. They therefore sounded warnings about increased premiums and lobbied for the law to change. They were successful and in 2013 the government forbade lawyers from claiming their success fees which means they had to go back to the other side.
