Surrey ‘no win, no fee’ claims

The idea of ‘no win, no fee’ is very simple. If you are not successful with your claim then you will not have to pay a single penny. This idea has been common for the last 15 or so years as legal aid was first cut back and then removed entirely from the vast majority of personal injury claims back in the year 2000. Today the majority of claims are made this way but there is considerable difference in what happens if you are successful with your claim.

Back in 2012, plans were announced to remove the ability of lawyers to claim their success fees from the other side when they won a case. This has profound implications for claimants. They would now have to pay the success fees from their own wallet and since compensation claims are worked out on the basis of how much injury and financial damage has been done, this would mean the amount compensated would be lower than they deserved.

However, not all legal fees have to be paid. Lawyers can still claim basic fees from the other side, which means you will not have to pay the majority of your costs. Some lawyers may also try to waive their success fees and live off these recovered costs. However, doing so represents a considerable financial risk and some of the firms who are doing this are finding it difficult to stay in business. This tends to affect the quality of the service they can provide as they try to save their pennies.

The level of the success fee may also vary from lawyer to lawyer so it’s important to find out how much you will pay if you do win before you agree to use any firm. The difference could in the end prove to be vital.
