Am I eligible to make a claim for compensation?
While you have the legal right to make a claim if you have been injured in an accident that was not your fault, whether you are still eligible depends on when your accident happened.
If legal proceedings are not started in court within three years, then your case will be time-barred, meaning you cannot bring the claim forward. This rule applies to 99% of cases, and the remaining 1% of cases are allowed through where the victim has been treated under the Mental Health Act 1983, or where the victim can otherwise show that they lacked the mental capacity to make a claim during the standard 3 year limit.
This limit also doesn’t apply to minors (people under 18 years of age). Somebody can make a claim on their behalf at any time. But minors only have 3 years from the date of their 18th birthday to make a claim, so time is still of the essence if this is the case with you.
