Because they only get paid if they win they will be more wary about those marginal cases.

You should also not be fooled into thinking you won’t have to pay anything no matter what happens. There is an assumption that law firms will be allowed to claim their success fees from the other side which means that you won’t have to pay even if you do win. However, this no longer happens which means you will be responsible for your own legal fees.
