    Making sure that products are safe so you don’t need to claim product liability compensation

    Manufacturers and importers have a responsibility to make sure that goods are safe and in working order. No matter how small or large their product is, the same laws apply.

    Distributors and retailers should also be aware that they have a legal duty to ensure that what they are selling is safe, and if they knowingly sell an unsafe product they will be just as liable as the manufacturers or importers. Retailers need to take particular care with high-risk products such as toys, fireworks, food and medicines.

    If they do not abide by the rules and regulations, there can be serious consequences: they can be heavily fined, or even imprisoned. Of course, there is also the fact that if someone was injured because of a defect, they could face product liability claims.

    What about services?

    If you hire someone to provide a service, such as a dentist, a builder or a physiotherapist, you could also suffer injuries in this way. Anyone providing such a service is just as liable to pay compensation in personal injury claims if they cause you to be injured.

    The insurance companies

    Product liability compensation claims would normally be covered by the manufacturer’s product liability insurance. The same applies to a service you buy – the insurance may have a different name, but it would still be the insurance company that settles any product liability claims made against their client.
