To claim or not to claim – that is the question we can help you answer at Accident Advice Helpline. Not only that, but we’ll also find a personal injury lawyer who works on a no win no fee basis, which means that whatever happens there is no risk to you. Here’s how you can come to a judgement about the chances of winning your case.
What the rules say
Accidents happen, but if they were caused by someone else and cause serious implications to your life then it is only reasonable that you should expect to receive compensation as a result. That’s what it says under UK regulations. You’ll have to demonstrate firstly that you weren’t at fault, secondly that the injury has affected your life, and finally that the accident was the fault of the defendant.
Because you will be the claimant in this case, the onus is thrown on you to prove your case, rather than just make an argument of probability. Therefore, it is not good enough to just be in the right – you have to be able to demonstrate that you are correct as well.
To do this, you’ll need as much evidence as possible. If you’ve been hurt in the street and the council left it in disrepair, get photographs of the scene as it was at the time of the accident. Things can always change over time and it’s probable that once an accident has happened, the council will want to tidy it up to stop anyone else having the same problem.
If you’ve been hurt in a car accident in which you feel the other driver was at fault, get the contact details of any witnesses at the scene, together with the names and numbers of any police officers present. You won’t need to contact them – leave that to your legal team.
As well as proving blame, you’ll have to demonstrate that your injuries were severe enough to warrant compensation. Keep any records of medical treatment you’ve received. When we work with people at Accident Advice Helpline, we sometimes also schedule medical assessments so we can illustrate how bad the injury is.
