How to start a claim for injuries

To begin with, you need to find out if you are eligible to make a claim. You can do this by contacting us at Accident Advice Helpline. You can talk to one of our experts and he or she will tell you if you have a valid claim to make.

Most personal injury compensation claims can be processed over the phone. You may need to have a second medical examination, but this is not always necessary.

Are you eligible to make a personal injury claim?

If you decide to make a claim for your injuries, you have to be in a position to prove that you were not responsible for your accident. It is also necessary to prove that another person or organization was responsible for your accident. You can’t make a claim for compensation against a wild animal, of course. If a deer or rabbit, or fox, cause your accident, then there is no claim to file.

You should file your potential claim within the limitation period for your accident. Usually you have three years from the date of an accident that happened in the UK to file a claim. This is not a hard-and-fast rule however, so contact us at Accident Advice Helpline to find out how long you really have to make your claim.

When the deadline for filing your claim is up, you could only file it if it can be proven that there were exceptional circumstances preventing you from filing it within the allotted time period.

You should also have had medical treatment for your injuries as soon as you could after the accident. Your medical records are required if you make a claim for injuries.
