    Something that a lot of people don’t know that when they have a personal injury claim is that there is a personal injury claim time limit that they may be under.  There are some exceptions to the rule of this time limit, however. There are some things that can affect whether or not the person is able to have more time to make their claim or if they might even have less time for bringing their case.  Below are some of the instances in which someone might have a longer or shorter time to bring their personal injury claim and what the examples are.

    Knowledge date may affect personal injury claim time limit

    In some of the cases where the claimant may not reasonably know they had some kind of injury or that someone else caused the injury, this could affect the personal injury claim time limit. This is really common when it comes to a disease that is related to asbestos, since it often doesn’t show any symptoms for a lot of years after the person has been exposed.

    Death affects the personal injury claim time limit

    If the claimant dies during the three years that they have had to file their claim, the person’s loved ones are going to have an additional three years starting from their loved one’s death to start their injury claim. This helps with people who are grieving and who believe that the person was done wrong.

    Mental Incapacity affects the personal injury claim time limit

    For those patients who are mentally incapacitated, this period that they have to take action aren’t going to begin until they’ve regained their mental capacity.

    Sometimes when a child has been injured by someone who abused them sexually or physically, they may be able to wait until they are older to take action against the person who has done them wrong.

    Accidents on ships or planes affect personal injury claim time limit

    Accidents that happen on a journey by boat or plane sometimes are going to be under international law statutes and they provide a time limit that is shorter, which means that the person has to bring it two years after the incident.
