Conditional Fee Agreements are more commonly known as “No-Win No-Fee” agreements. No-Win No-Fee Agreements were introduced in 1998 when it was decided to withdraw Legal Aid for personal injury cases. No-Win No-Fee agreements were primarily designed to broaden access to justice for those without funds to pay expensive legal fees.
No-Win No-Fee Agreements are typically used in all sorts of civil litigation whether that’s a personal injury claim, a complaint against an Employer, or in many Clinical negligence cases, the NHS.
With No-Win No-Fee there are no up-front legal costs and if you don’t win your case, you don’t pay a penny.

No win no fee* accident compensation
Compensation can be claimed for “General Damages”, which can be difficult to calculate. They include ‘pain and suffering’ (for both the initial injury and for any continuing suffering or disability) and ‘loss of amenity’ which is loss of the enjoyment of life, for example if you can no longer partake in a leisure activity due to your injury.
No win no fee* compensation may also be awarded for loss of earnings caused by permanent injury. Future losses are also included in accident claims calculated according to the estimated annual loss to arrive at a fair figure for compensation.
No win no fee* special damages compensation
In addition “Special Damages” can be claimed, these include items that are usually easier to calculate accurately;
- Loss of earnings whilst injured
- Prescription charges and medical costs
- Property damage
- Insurance excess
- Damage to Vehicle
- Special care aids and equipment
- Adapted transport
- Car hire
- Travel expenses
- Cost of assistance
- Costs of care
- Adapted accommodation
- Out of pocket expenses
