When you can make a no win no fee* compensation in East Dorset claim against your employer

If you have had an accident at work there is a chance that you can make a no win no fee* compensation East Dorset claim against your employer. However, it is important to be aware that just because you have an accident at work, or on work premises, this doesn’t mean that the accident was necessarily your employer’s fault. In order for you to make a personal injury compensation claim you would have to prove that you were not to blame for your accident and that it was the fault of another person.

So, under what circumstances can you make a claim against your employer? In all honesty there are lots of different situations, but we will talk through some of the most common ones that we deal with here at Accident Advice Helpline.

    Insufficient training

There are certain situations in work that you may need to undergo specific training. For some, this may be how to use the CCTV system or the franking machine, perhaps even a course on how to write letters or documents in the house style. However, for other people training is an essential part of how to do their job safely and efficiently.

For example, if you are working in a factory or warehouse then you may be required to work with specific machines or large pieces of equipment. Your employer should never take for granted that just because you have worked with something similar in a previous employment that you have the necessary skills or knowledge to continue to work with the machinery. It is essential that additional training is provided to make sure that you are up to speed with what is required of you.

If you are injured as a result of working with machinery, and your employer has not provided you with the training to ensure your safety, then he or she could be regarded as being liable because of negligence. In this instance then a personal injury compensation  claim could be made.

    Lack of personal protection equipment

Some jobs are inherently dangerous and there is little that can be done to completely remove that danger. However, in such situations your employer should do all they can to ensure that the risks posed are minimised as much as possible. For example, if you are working with chemicals, perhaps as a cleaner, that could cause irritation to your skin, then your employer should identify this (usually via a risk assessment) and provide you with gloves to offer protection. If they fail to do this, then you can make a no win no fee* compensation East Dorset claim.
