However, until recently you would probably not have to pay even if you did win. That’s because the government allowed law firms to claim compensation from the other side. So this was the deal you had – ‘no win, no fee*’ and ‘win, no fee’.

    Critics said that this made it too easy and that people would have been encouraged to make a claim on the off-chance. However, we don’t think this was the case. Because firms were working on the basis of ‘no win, no fee*’, they still faced a considerable risk whenever they agreed to take on a case. As such, if they lost then they would be out of pocket.

    However, with the backing of the insurance companies the government ruled that success fees could no longer be claimed by law firms. This left them in difficulty. Did they turn to their customers for the money or try to get by on the basic fees they received and could still claim from the other side.

    Some smaller firms struggled to cope and this is important because it might lead to them being less than selective with the types of cases they take on. Those who are struggling to make end meets will chase compensation on the off chance which will reduce the quality of service you receive.
