Some common questions asked by those making a negligence claim in Thurrock
We see a number of common questions when people come to us to ask for advice. Here are some of the frequently asked questions from Thurrock residents.
How long do I have to make a claim?
A lot of people do not actually realise that there is a time limit on all personal injury cases and this is three years. You have three years from the date of the incident to make your accident claim. If you have sustained an injury that has occurred over time, which is usually the case with workplace accidents, then you will have three dates from the diagnosis.
Will I have to go to court?
It is impossible to say yes or no, as there is always the possibility of a court case. However, it is incredibly unlikely. In fact, less than three per cent of personal injury cases end up going to trial.
Could I be fired for making a claim against my employer?
If you are making a claim against your employer you are probably feeling a bit worried about their reaction. However, this is something that should not concern you. So long as you have a genuine reason for claiming, your employer will understand that you need to be compensated. They will have insurance in place to cover this and if they were to dismiss you they would only end up in more trouble.
How much compensation will I receive?
Every case is different and there are no guarantees. Nonetheless, the amount you receive will be calculated based on two things. Firstly you will receive general damages to compensate you for the injury, taking into account the severity of it and the impact it is having on your everyday life. Secondly, you will be compensated for out of pocket expenses you have experienced as a result of the injury.
