Making an injury claim in Kessingland
You can also file an injury claim in Kessingland if you have a work-related illness or an occupational disease and have been diagnosed with this within the last three years. You can claim for any illness which was caused by another person’s negligence.
Accidents in holiday parks
You may have been on holiday in the UK and stayed in a holiday resort park where there is accommodation plus a water park and other facilities for all the family. If you have an accident while at one of these parks, you may be able to make a personal injury compensation claim against the owner. However, claims can only be made if negligence on the part of the owner can be proved.
In 2009 a couple were ordered to return the £25,000 compensation they had received after finding their 2 year old son face down in a puddle in a holiday park in 2004 in north Wales. Three appeal judges ruled that the owner had not been responsible and said that “accidents may and do happen to young children without anyone being at fault.”
If you can prove that the equipment you were using was defective in some way, then you could have an injury claim to make against the owner or the holiday park, or if you took a foreign package holiday, booked through a UK tour operator then you can sue the operator because the owner of the park was and probably still is, the tour operator’s representatives in the eyes of UK law.
