If you believed everything you read in certain newspapers, you’d probably pretty quickly form the opinion that everybody who was involved in an accident that was not their fault was taking some form or another of 100% no win no fee personal injury action against the person or organisation that was responsible for their suffering. You might be surprised to learn that this is very far from the case.

The truth is that many people who are injured in accidents that were not their fault do not take action, for a number of reasons. A YouGov study conducted in April 2014 found that only 25% of people who had been injured in accidents that were not their fault went on to take action — down from 29% when the study was last carried out, in July the previous year. The polling organisation asked those who did not take action why they decided not to do so, by calling an expert legal team i Essex, or anywhere else.

Why people do not take personal injury action after being injured in an accident that was not their fault

The most popular reason people did not take personal injury action in April 2014 was that they did not think the illness or injury they suffered was serious enough to warrant a payout. Some 35% of poll respondents cited this as a reason for not seeking recompense for their suffering.

A staggering 22% said they did not make a claim because they did not believe in pursuing compensation, which seems a very strange response to being made to suffer as a result of a third party’s negligence.

9% of those who decided not to make a personal injury claim after being involved in an accident that was not their fault said they failed to do so because they did not think their case was strong enough, while 7% said they thought the process of taking action would be too lengthy a process. A further 5% said they were worried about the costs involved in pursuing a payout.
