Where the 3 year deadline differs…
There are two cases in which the application of this deadline differs:
Cases involving children under 18 and cases involving industrial diseases.
- Minors – Next of kin (in terms of children, usually the parents or legal guardians) can make a compensation claim during their young years but it must be resolved within 3 years of their 18th birthday, if not before. - Industrial diseases – The three year deadline begins on the date you were told you had an industrial disease or from the date it could be reasonably assumed your have an industrial disease.
