Of course, this is one of the richest areas of London, populated by some of the most wealthy people in the world. But on the off chance that you’re not an oligarch or someone looking for a place to park your yacht for the winter, ‘no win, no fee’ can be a real life saver.

    For most of us mere mortals, it sometimes feels as if the government is engaged in a determined effort to exclude us from the legal system. Legal aid has been cut back across the board which sparked many solicitors to take to the streets in protest at what was happening. This is the only way some people are able to afford the expensive process of standing up for their rights in the law courts.

    How we work

    When we started, legal aid had just been removed from the majority of personal injury claims which means people were casting around for alternatives. ‘No win, no fee’ which is also known as the conditional fee arrangement was the best option. This transferred the financial risk of making a claim from the client and onto the law firm. In return the government allowed law firms to increase the amount they charged so successful cases off set the amount they would lose by pushing a claim which was not successful.

    The benefit of this is that if you live in Kensington and Chelsea, no win, no fee’ compensation offers a less risky way to make a claim. It also means that you can have more faith in the efforts of your law firm. After all, if they don’t win the case they do not get paid so they will be incentivised to do their best.

    However, there are downsides as well. No win, no fee’ is a risk for the law firm and for smaller firms it can be a real problem. This may lead them to reject claims which have some merit but represent too much of a risk. Ironically, this is often the most urgent cases in which support is needed more than anywhere else.
