    Claiming insurance for personal injury

With 15 years worth of experience in the personal injury claim sector we here at Accident Advice Helpline have handled accident injuries in various sorts of circumstances and scenarios. It could be personal injury that you sustained in the home, a personal injury that suffered in the workplace, or a personal injury that you incurred simply when you were out and about. But before you can consider raising an insurance personal injury claim, there are several factors you will need to consider first.

    Important qualifying factors

The first and probably most important factor is that someone other than yourself must be to blame for the accident or incident that led to your injury. In this context the injury can also be an illness relating to your occupation and here you will need to be able to show that your employer has failed to provide you with a safe working environment.

Once we’ve clearly established that the blame for your injury lies at someone else’s doorstep, the next thing we need to consider is both the validity and seriousness of the injury/illness you sustained or contracted. This means that you will need to be able to supply proof that you received medical treatment for your injury/illness.

Last but not least we then need to confirm that the injury has occurred within the 3 years immediately preceding the date of your claim. This is in order to satisfy the 3 year statute of limitations. In the cases of work-related illness, the 3 year statute can be extended given the right circumstances. The only other circumstances where this 3 year rule is more flexible, is in the case of minors. In this instance the 3 year clock doesn’t start counting down until the injury victim’s 18th birthday.
