    Important qualifying factors

    The first and probably most important factor is that someone other than yourself must be to blame for the accident or incident that led to your injury.     Last but not least we then need to confirm that the injury has occurred within the 3 years immediately preceding the date of your claim. This is in order to satisfy the 3 year statute of limitations. In the cases of work-related illness, the 3 year statute can be extended given the right circumstances. The only other circumstances where this 3 year rule is more flexible, is in the case of minors. In this instance the 3 year clock doesn’t start counting down until the injury victim’s 18th birthday.
