"If you've been injured through no fault of your own you could be entitled to compensation. If you're unsure if you could claim, I recommend you call Accident Advice Helpline."

If you feel that your doctor has caused an illness or injury to get worse, or has caused a new illness or injury due to negligence, then you may be able to make a claim for compensation. The process isn’t as complicated as you think, as long as you have good injury solicitors behind you, but it is helpful to do your research in advance so you know what is likely to happen and what you should be doing.

Work out who you are claiming against

Although you may think that this would be obvious, in many cases it is not as straightforward as it could be. You may want to claim against a specific doctor, or a hospital as a whole. Perhaps a specialist caused your issues, or the actions of the team as a whole. Work out exactly who is at fault for your illness or injury and decide that this is the person you are claiming against. You may need to ask around a little to find out the name and titles of the people responsible, and you might also want to think about who is going to be able to afford a payout. Even if you think a nurse is to blame for your situation, you might want to sue the hospital, as they have more access to a larger sum of money.

    Provide evidence

Your solicitors will need all of the evidence and information you can provide to prove that the person you are claiming against truly is at fault for what has happened. Provide them with medical records, detailed lists of when symptoms began and were made worse, anything you have been told or medications which have been prescribed. The more information your solicitors have the more likely it is that you will make a successful claim.

    Consider any settlement

Many hospitals and larger corporations will prefer to settle out of court than to go through the whole process. This may mean that they offer less compensation than you could get, but possibly more than you will get if you go through court. Think carefully about any settlement which is offered and take it if you feel that is accurately represents what you have been through, and the expenses you have already paid out.
