    The criteria for claiming compensation

    There are certain rules your situation has to comply with so that you qualify for compensation:

    • You have to have been involved in an accident that was the fault of someone else. That could be another driver if it is a road traffic accident, your employer if it is an accident at work or a company or local council if you are hurt in a public place.
    • You must have suffered a personal injury in the accident. Compensation is paid for the injury you suffered, as well as for any costs and losses the accident caused.
    • Your injuries needed medical attention. This does not mean it had to be a life threatening injury, there are many more minor injuries that require you to go to your local A & E or doctor.
    • The accident should have happened within the last three years. There are some exceptions to this rule, such as if the injured person was a child at the time of the accident, or you are claiming for an industrial disease. Both of those two example give you more time to make your claim, but there are also some with a shorter time scale such as being injured at sea or in the air.
