63-year-old worker struck by a reversing forklift
It pays to keep forklift trucks and pedestrians apart as much as possible. Most companies paint lines in their factory floors indicating pathways that are kept forklift free. A chemical company in Lincolnshire had done this, but had then unfortunately allowed the forklift free path to become obstructed in their “goods out” department. It was as a 63-year-old employee circumnavigated this obstruction and wandered off the pedestrian path, that he was struck by a reversing forklift truck.
Work seriously injured and flown to hospital by air ambulance
The injury victim was seriously injured. He sustained internal bleeding, 2 of his lower vertebrae were fractured, and he suffered severe tissue damage to other parts of his body, including his neck, back, shoulders, thighs, and knees. He was rushed to hospital by air ambulance.
Workers forced to enter forklift busy zone
The chemical company were culpable. Not only had they allowed the pedestrian pathway to become obstructed, but they also taped it off, meaning that pedestrian workers had no alternative other than to enter an area where forklift trucks were actively working and reversing. The company took no measures to provide an alternative safe route for workers on foot.
At the hearing into the incident, the plastics company entered a plea of guilty in terms of breaching Section 2(1) of the Health and Safety at Work etc. Act 1974. They were £12,500 and instructed to pay costs of £5,261.Open Claim Calculator
