If you live in the area, you may be thinking of making an injury claim in Llanfair Waterdine, perhaps because you have been injured in an accident that you can prove was the fault of another person, or because you have (or have had) an illness that you can prove was the result of another person’s negligence.

    Injury claim in Llanfair Waterdine

You have to make most injury claims within three years of the date of an accident or of first being diagnosed with an illness. However, in the case of some accidents you only have two years in which to make an injury claim in Llanfair Waterdine. You have to make a claim for an accident which occurred in the air, at an airport or at sea within two years, as such accidents are governed by international conventions. If you were the victim of a violent crime and had not provoked your attacker in any way, you can make an injury claim in Llanfair Waterdine, or elsewhere in the UK, through the Criminal Injuries Compensation Authority (CICA), but again you have only two years to do so.

Why wait to file a claim?

Generally, the sooner you begin proceedings for personal injury compensation, the better. You may be lucky and get a good out-of-court settlement, which you could receive within six months of making your claim. However, your solicitor may advise you to reject an initial offer of compensation because it is not a reasonable amount to compensate you for the pain, distress and suffering caused by your injury or illness. There may then be a better offer and you won’t have to take the claim to court. However, if the person you allege to be responsible for your illness or injury denies liability, then the case will have to go through the court system.

Your solicitor might advise you to wait until you have fully recovered from your injury before you file a claim. A doctor can tell you and your solicitor how long it could take for you to make a full recovery, or say that you will never fully recover. You may be asked to have another doctor assess your injury or illness so that your case is strengthened.

If you are expected to make a full recovery within three years, then you could wait to make a claim. Generally, the longer it takes you to recover, the more you might receive in compensation, which is why a solicitor may advise you to delay making an injury claim in Llanfair Waterdine, for example.
