Young pupil trapped by primary school’s electric gate
A school in Leicester was recently prosecuted for failing to have adequate protection in place when a pupil at the primary school was trapped by the school’s electric gate.
The young pupil, (an 8-year-old boy), was trapped between the gatepost and the closing gate. Luckily, his father was on the scene and witnessed the incident. He rushed to his son’s aid, and managed to forcefully pull the gate back fractionally; enough to free the boy’s trapped head. He was not severely injured, but sustained significant bruising, both to the right side of his head, and to his right ear.
The gate had been retrofitted with an electric motor to facilitate automatic opening and closing. The company who fitted the motor had identified the need for some sort of guard, but because the gate itself, (supplied by another contractor) was not the design they expected, no guard was fitted at the time.
Contractor fined and ordered to pay costs
At a subsequent investigation carried out by the HSE (Health and Safety Executive), the company who fitted the motor were found to be in breach of Regulation 8 of the Workplace (Health, Safety and Welfare) Regulations 1992.
