Fatal tailgate accident
A number of injuries happen every year relating to tailgates that have been fixed to vehicles to facilitate loading and unloading. A tragic accident happened in Southminster, Essex, when a worker was killed by a tailgate that had been inadvertently operated when he was leaning into the back of the vehicle.
The 63-year-old man leaned into the back of the vehicle to talk to a colleague who was inside. Unbeknown to him the driver of the vehicle activated the tailgate.
Injury victim died at the scene of the accident
This particular tailgate together with the other tailgates fitted to the fleet of vehicles, had been modified and extended. When the tailgate closed, it closed so quickly that the injury victim, although verbally warned, did not have time to avoid becoming trapped. He suffered crush injuries and died at the scene.
The accident was eminently preventable
At a later hearing, the court was advised that had barriers been erected around trailer to prevent unauthorised access, this tragic accident could have been avoided.
The company had a poor health and safety track record
When the HSE (Health and Safety Executive) investigated the company concerned, they found a number of other dangerous practices that were happening as a matter of routine throughout the site. For example, employees standing on stacks of pallets to clean equipment in the same area where lorries were reversing. This was taking place at the time of the fatal injury referred to above.
The same company had been prosecuted on three earlier occasions for health and safety issues. One relating to an employee who lost his arm; another who suffered a broken arm, and a third who sustained serious burns.
The company were found to be in breach of Section 2(1) of the Health and Safety at Work etc. Act 1974 and Regulation 5(1) of the Management of Health and Safety at Work Regulations 1999. They received a fine of £100,000 and were instructed to pay costs of £28,437.
