    If you’ve been injured in an accident, you may be considering making a claim for compensation to cover the costs of your injuries. However, you will need to be certain that the accident that occurred was not your fault, and you were not to blame for it occurring. So how can you be sure that you were not ultimately responsible for an accident occurring?

    The people who are responsible for the area in which the accident occurred are legally obligated to make sure the area is safe – usually this would be your employer if the accident happened at work, or otherwise the person in control of the premises.     If, for example, the workplace you are in required you to wear special protective equipment in order to work there, and you were not wearing the appropriate protective gear and were injured as a result, it is very unlikely you would be able to claim.

    This is because you were required to wear equipment designed to minimise hazards to your health and chose not to. However, if you were wearing protective equipment but the equipment was faulty, or you were not trained how to use it properly, and were injured as a result, it may be ruled that the accident was not your fault, and you could claim compensation through an injury claim in Dumfries and Galloway.
