One of the things that puts many people off making a personal injury claim in Cumbria, is the costs they think will be involved. This really is something they should not worry about, as at Accident Advice Helpline we use the no win, no fee agreement for all our claims, whether it is a personal injury claim in Cumbria or anywhere else in the country.
No win, no fee agreement for a personal injury claim in Cumbria
For a very long time, the law in the UK has said that if in the previous three years you have been injured in an accident that was not your own fault, and your injuries needed medical attention, then you have the right to claim compensation from whoever was responsible.
These days only 3 out of 10 innocent victims make a compensation claim, but for many years, even fewer did because they could not risk losing the claim and having to pay the legal fees.
In the 1940’s the government tried to address this problem with the introduction of the legal aid system, and this did help to some extent. But now we were in a situation where the wealthy among us could afford to claim, and the poorest could as well because of legal aid. This was means tested, and as with any government income-based benefit, you had to be practically on the poverty line for the legal aid system to help you make a personal injury claim in Cumbria.
The introduction of the conditional fee agreement
In 1998, legal aid was withdrawn from the personal injury claim industry, but the 1999 Finance Act replaced it with the conditional fee agreement. This came into force in April 2000, and very quickly earned the nickname, no win no fee. This is how most people refer to it, and it means exactly what it says: You do not have to pay any money for your claim to be started, and you do not have to pay any money if your claim is lost.
So on top of the trauma your accident has caused, you will not have the additional worries of financing a personal injury claim – no win, no fee takes care of it for you.
