    If you are wondering how much compensation you may get for an injury sustained in an accident that was not your fault, you might have grounds to make a personal injury compensation claim. How much compensation for falling in public could you receive?

    If you had your accident less than three years ago then there could still be time to make a claim, although there are exceptions and you may only have two years in which to file a claim from the date of your accident.

    How much compensation could I get for my injury and how is it assessed?

    Compensation is given according to the severity of your injuries and it is also  assessed on the type of injury you have:

    • how severe your injury is.
    • how long recovery takes.
    • how the injury has affected your daily life.
    • how and if the injury has affected your leisure time activities.
    • how the injury could affect your long-term position as regards work.
    • the treatment needed in the past and future.
    • if you had a pre-existing medical problem which was exacerbated by the accident.

    When you claim compensation for an injury or an illness, your solicitor will need to have your medical report which details whether or not you will make a full recovery, and, if you do, how long it might take. You can also claim for any loss of earnings and medical treatment and any costs which you incurred because of your injury or illness.

    Compensation is designed so that you are no worse off financially after your illness or injury than before.

    Your solicitor can consult the Judicial Studies Board guidelines and can give you an estimate of how much compensation you could get for your injury. Research will also have to be done into recent awards for claims such as yours, so that your solicitors can estimate how much you could get.
