    A holiday injury can completely ruin your holiday, but if the accident in which you sustained your injury was not your fault, you may be able to claim personal injury compensation. You may have hired a car whilst on holiday in another country or perhaps you hired a motorcycle or motorbike which had not been serviced and properly maintained. You can claim personal injury compensation for accidents that were no fault of yours, if you can prove that another person’s negligence was to blame for the accident. If you were injured in a road accident in another EU state, then you may be able to claim compensation reasonably easily, as such accidents are covered by EU 4th and 5th Motor Insurance Directives.

    Holiday injury at a hotel

    If you booked a package holiday with a UK-based tour operator or travel agent and had an accident at the hotel which was caused by another person’s negligence, then you can make a personal injury compensation claim against the tour operator. The hotel owner would be seen, by law, to be one of the tour operator’s representatives.

    You may have fallen over an obstacle which should not have been on a path, perhaps a wheelbarrow or any other gardening implement which should have been put away in its proper place. There may have been some broken paving with no hazard signs in place to warn you of the danger and you could have tripped and broken a limb. You may have been stuck in a hotel lift for some hours which left you psychologically damaged and you may be able to claim for this too, if the experience was so traumatic that it ruined your holiday (this is an example of a psychological injury).
