    Holiday accident

    If you have sustained an injury in a holiday accident, then you could have grounds for making a personal injury claim. If the holiday accident was not your fault but the result of another person’s negligence (and you and your solicitor can prove this), then you may be able to claim personal injury compensation if your accident occurred within the last three years.

    Holiday accident abroad

    You may be able to claim personal injury compensation if your holiday accident happened abroad, if you booked the holiday through a UK-based travel agent. If the accident was caused because of the negligence of one of the travel agent’s representatives (a hotel owner, your holiday representative and so on) then you could be entitled to make a claim against the travel agent.

    However, if you got food poisoning after eating out at a local restaurant, you would not be able to make a claim under UK law. If, on the other hand, you got food poisoning after eating at the hotel restaurant where you were staying, and you received hospital treatment, then you could make a claim. You would need to prove that the food had not been properly prepared, or it had been improperly cooked.

    You can claim if the bed in the hotel collapsed while you were asleep and you injured your back in the fall. The bed could have been faulty and this should have been noticed by the hotel staff and the owner should have been informed. This would be an example of negligence. You could claim for your injury and the pain, distress and suffering caused.

    You would not have a claim to make in the UK if you were injured while travelling on a local bus because of a road accident. You could claim personal injury compensation if you were travelling on a coach which the travel agent had hired for an excursion or trip to the airport and so on.

    Holiday accident in the UK
