    From the moment it was introduced though, it became the subject of considerable controversy. First of all, to compensate the law firms for agreeing to offer no win no fee the government allowed them to increase the level of legal fees they were permitted to charge. As such those who made successful personal injury claims tended to find themselves paying for the fees of those who did not.

    Secondly measures were put in place to allow lawyers to claim their success fees from the other side. Because compensation was calculated on the basis of how much damage had been done by the injury, anyone who decided to make a personal injury claim might end up being under compensated. This way meant that if people lost a case they would not have to pay and if they won their case they wouldn’t have to pay.

    This created a strong reaction from the insurance companies who feared an increase in the amount of personal injury claims. They warned that people would be making claims for marginal injuries, and although this did not happen the government believed them. They removed the ability of lawyers to claim success fees from the opposition, which means that clients now have to pay for their own claims.
