    The history of No Win No Fee and how its effect is the free injury solicitor

    No Win No Fee has been around since 1995 when it was first allowed for some court cases in England and Wales.  Three years later it was extended to all civil cases, with the exception of action in the family courts and this coincided with the abolition of legal aid for personal injury compensation claims.  The idea was to give better access to justice for everyone, no matter if you were really rich or so poor that you would have previously qualified for legal aid.  It was no longer down to financial circumstance if you could afford to make a personal injury claim, but on having a genuine case and this was good for the free injury solicitor.

    Free injury solicitor may cost you nothing

    The 1999 Access to Justice Act, which came into force in April 2000, made these no win no fee deals much more attractive as it meant judges could make the losing side pay the costs, including the cost of the injured parties solicitor, so avoiding the need to take the costs from the compensation awarded in some cases.

    From a solicitor’s point of view, it meant they could do a lot of work on a case but lose; this really did make them become a free injury solicitor.  It also meant that a lot of sham claims were no longer made, solicitors now will only take on the genuine claims, so the civil courts became more accessible and waiting times reduced.

    Bad press for the free injury solicitor

    Originally there was a lot of bad press about the scheme suggesting that it would open the floodgates to compensation claims.  However, figures show that this has not happened; there are very few more cases now than there were then, but it would appear that people are being awarded larger amounts.  This is partly because of the loss of earning element, as wages have risen so has this.
