The investigation found that the owner of solar panel business had failed to carry out an adequate risk assessment prior to work taking place. Had he done so, measures could have been put in place to prevent the incident, and the need for the victim to make a fall injury claim in York.

    The health and safety tribunal concluded that both brothers were lucky not to have suffered more serious injuries. Working on roofs is not only dangerous but actually accounts for more deaths in the construction industry than any other type of accident. That is why the Work at Height Regulations 2005 were put in place. In this particular instance the owner of the solar panel business did not fulfil his duty of care to his employees. He was fined £4,500 and instructed to pay costs totalling a further £1,500.
