Are you looking for experienced injury lawyers in Kennington?
If searching for experienced injury lawyers in Kennington, the enquirer will get plenty of choice, because Kennington is a district in central London. Roughly one third of all road accidents in the UK occur in London and the South East, so there is a strong possibility someone seeking injury lawyers in London will be a victim of a road traffic accident (RTA), sustaining injuries that weren’t their fault. By far the greatest percentage of these RTA claims are for ‘so-called’ whiplash.
What is a genuine whiplash claim?
‘So-called’ because the term ‘whiplash’ is subsumed by the umbrella term ‘soft-tissue injury‘, and these two together account for 87% of RTA claims. Fortunately, advances in diagnoses and medical procedures have enabled more accurate assessment of claims for injuries to the neck, although it is recognised that more diagnostic precision is needed to fight the fraudsters.
Backlash on whiplash?
In November 2013, the House of Commons Transport Committee is debating a report on the rising cost of car insurance and measures that can be taken to reduce it. According to the Justice Minister, Shailesh Vara, recent government changes in the rules for personal injury compensation claims have resulted in a 20% reduction of personal injury claims for RTAs..
The index published by the Automobile Association (AA) in October this year showed that premiums for comprehensive motor insurance have fallen by 12% in 2013. This is important because whiplash claims, genuine and fraudulent, have been running at 1,900 per day, costing the motor insurance industry £2 billion, and adding an average of £80 to the annual motor insurance premium.
However, Shadow Justice Minister Andy Slaughter reminded the committee it was important to remember the needs of genuine victims of RTAs and that the ‘soft tissue injury’ category covered a multitude of injury types, of which whiplash was only one. The ‘soft tissue injury’ accounted for a high percentage of claims, because improvements in vehicle safety designs had lessened the impact of many accidents from serious trauma to soft tissue only.
It was generally agreed by all parties that the claim validity period should not be reduced from 3 years to 1 year, since a significant number of claims cases concerned more complex injuries than just whiplash (from which the majority of sufferers recover within a year).
