What is the estimated payout for whiplash?
It is almost impossible to give an accurate estimated payout for whiplash, because there are so many different things to take into consideration and people react in different ways to the same thing, often resulting in varying degrees as to how their injury affects their life.
Estimated payout for whiplash based on previous cases
The only way even a reasonable estimated payout for whiplash can be given is based on previous cases that were similar. If your case ends up in court, which a lot do not, the judge would consider how much hardship the loss of earnings, for example, has created. Depending on your financial circumstances, the same loss of earnings could result in totally different situations for different people.

- Are you likely to have ongoing problems? The severity of whiplash is not always immediately apparent and can get worse over time.
- Have you had to lose time from work?
- Have you had extra costs because of the accident?
Will the estimated payout for whiplash be from an insurance company or someone else?
That really depends on who was at fault in the accident. In most car collisions, it would be the insurance company of whichever driver was at fault. If it turned out that the other driver had no valid insurance, the claim would be referred to the Motor Insurers’ Bureau who are there to ensure you do not lose out because the other driver was using their car illegally. If your accident was caused by a run in with a pothole or a bad road surface, it would be the authority that is responsible for maintaining the road in that location. If the brakes failed on that new car you recently purchased, it would be the manufacturer.
