Establishing who is liable for an accident whilst on holiday

The first stage to claiming compensation if you’ve been injured while away from home, is establishing who is liable for an accident whilst on holiday. Not all accidents mean you are eligible to make a claim, but if you were not to blame Accident Advice Helpline can give you free, no-obligation advice over the phone.

    Who was at fault?

You can only claim compensation if someone else was responsible for causing your accident. Sometimes this is obvious and on occasion, the person responsible may admit liability. If you contributed to your accident, you may not be able to claim, or your compensation may be reduced.

If you are on holiday and you are injured, always report your accident where it happened. If you tripped over loose carpeting in your hotel, or your balcony was loose, report it to them. They will have a book where all accidents are recorded.

As well as reporting your accident, there are other ways you can help Accident Advice Helpline to find out who was responsible.

If it happened in a public place, other people will probably have witnessed what happened. If you ask, they are usually happy to provide their contact details in case you need a statement from someone about what happened

The scene of an accident can often provide information about what happened so if you can, get some photographs. Your mobile phone will be fine for taking these.

If you are away from home, establishing who is liable for an accident whilst on holiday is much easier if you collect as much information as you can while you are still there.

If you need help just call Accident Advice Helpline

The friendly advisors at Accident Advice Helpline can take the details of your accident over the phone and confirm if you can claim. After your accident, have your injuries treated by a doctor so that they can provide you with medical evidence. If you are on holiday you should be able to find a local doctor you can see you as a temporary patient, and they will pass that information back to your own GP.
